Remember the old adage about pornography? Can the same be said of office relationships? What exactly constitutes an office relationship, and what rules—if any—should be applied to one? From judges to presidents, our society finds it incredibly difficult to establish definitions for anything having to do with sex. And, yet, sex constantly gets people in legal trouble…not to speak of other types of trouble. So, despite subjective definitions that change with each generation or new court case, workplaces need to establish and regularly update their parameters of acceptable behavior. Yes, a firm has legal obligations to protect employees from sexual harassment and hostile work environments. It also has an obligation to protect its clients and itself from conflicts of interest. What constitutes an office relationship?

Most of us have been there before. We become attracted to a co-worker and are not sure what to do about it. The policy was that a partner should not date a senior in the firm any more than a senior should date a junior staff accountant. If such dating eventually led to marriage, then one of the two must resign because of the conflicts of interest. Over time, the two brought their relationship into the workplace by going out for lunches and coming back late, and the partner even sent flowers to the senior signing it with a nickname that another staff member knew about it. A friend of the senior saw the note and became worried for her friend so she asked to speak to her.
Basically, the friend said that others on the audit engagement were aware of the relationship between the two and she was jeopardizing her position with the firm. The senior started to see the errors of her ways and that ethical blindness allowed her to rationalize her actions because the relationship was quite satisfying. That night the senior called the partner and explained they had to put their relationship aside for the remaining two weeks of the audit engagement and then discuss where to go from there.
The partner did not react in a supportive manner. In fact he said: As luck would have it the controller of the client was at the same restaurant that night and saw them acting in a romantic way.
New York State Domestic Violence and the Workplace Model Policy for Private Business Policy Statement Domestic violence permeates the lives and compromises the safety of thousands of employees each day, with tragic, destructive, and often fatal results. Domestic violence occurs within a wide spectrum of relationships, including married and formerly married couples, couples with children in common, couples who live together or have lived together, gay, lesbian, bisexual and transgender couples, and couples who are dating or who have dated in the past.
Domestic violence is defined as a pattern of coercive tactics which can include physical, psychological, sexual, economic and emotional abuse perpetrated by one person against an adult intimate partner, with the goal of establishing and maintaining power and control over the victim. In addition to exacting a tremendous toll from the individuals it directly affects, domestic violence often spills over into the workplace, compromising the safety of both victims and co-workers and resulting in lost productivity, increased health care costs, increased absenteeism, and increased employee turnover.
The purpose of this Model Policy is to identify and prescribe practices that will promote safety in the workplace and respond effectively to the needs of victims of domestic violence. Companies are urged to use this Model to develop their own specific policy to achieve these objectives.
Questions about Workplace Dating Policy Workplace dating is not allowed in many companies. There are many reasons for an employer to enforce an employee dating policy that discourages or prohibits workplace dating.
Cultural attitudes seem to be changing toward in-office romance. Here’s a breakdown of the legal ramifications of making and breaking a company policy. Getty As the old saying goes “you don’t dip your pen in the company ink. Is this age-old adage becoming extinct? If you believe the stats of new employees entering the workforce, it might seem so. But a lot of companies don’t let the rank and file decide–they adopt policies that ban or limit workplace dating–all in the name of lowering liability.
Enforcing these policies can take their toll on a company. Just last month, Gary Friedman, the chief executive of Restoration Hardware, stepped down in the middle of the company’s public offering. Friedman was not married, so there was no affair. She didn’t even work there anymore! In your policy, require all employees to report a dating or romantic relationship to the Human Resources department. When the employer learns of a romantic or dating relationship between two employees, it may be wise to present both employees with a copy of the non-discrimination and anti-harassment policies and remind the parties that they are.
Most employees spend as much time with their co-workers as they do with their families. Close relationships among co-workers can foster enhanced communication and efficiency, but employers must take care to avoid relationships that expose the company to claims of sexual harassment. Fraternization policies help employees understand where to draw the line with co-workers. Purpose The fraternization policy begins with a statement of its purpose. Companies intend for policies of this type to prevent favoritism, avoid misunderstandings, protect the company from sexual-harassment claims and avoid the loss of morale that may occur when a manager or supervisor has a romantic or flirtatious relationship with a lower-level employee.
Fraternization policies are not intended to prevent employees from forming close personal relationships with colleagues or to prevent romantic relationships from developing among peers. Prohibited Relationships A policy should clearly spell out which conducts are forbidden and which are permitted. The policy may require an employee who engages in a romantic relationship with a co-worker to report it to his supervisor so the company can determine if it violates the policy.
Exceptions Companies can recognize policy exceptions, which should be properly documented in the form of a stipulation, or agreement, between the individuals involved. The stipulation acknowledges that a relationship exists, despite the policy, and is voluntary and consensual, and that each individual understands the associated risks, such as, for example, the risk that their business interactions may be affected because of their personal relationship. No Policy A company is not obligated to implement a workplace fraternization policy; many companies do not have them.
For example, the CEO of a major software company married a product manager; the chairman of a top automobile brand married his secretary; and the editor of a national fashion magazine married her former professor. Whether or not a company implements a fraternization policy depends on the size and type of the business and its corporate culture. She has been a freelance writer since

It can be tricky. We didn’t meet on the job — we were dating for almost four years before we started working together which, by the way, wasn’t planned … long story. But for about 11 months, we sat three cubes apart from one another and kept our relationship under wraps. Nobody knew we were a couple. My answer to all three: But they happen all the time, and when they do, there are three possible outcomes: Remember that coworker I dated?
